Writing a will

    A will determines who receives the assets in your estate on the event of your death. While the assets of those without wills will eventually be distributed according to state laws, this can take a significant amount of time and is certainly not a good way to go if special needs children are a factor.

    Do you need a lawyer to make a will? Those with extremely uncomplicated circumstances may get away with using a “will kit” or website that allows you to draw up your own will. But parents with the challenge of drafting a will that considers the needs of their special needs child should use the services of an experienced attorney—not just one who has experience drawing up wills, but one who has drafted wills for parents of children with disabilities. An experienced attorney can draft a will that has the least amount of impact on any government benefits that your child is receiving, and can also ensure that she receives the treatments and therapies she needs following your death.
