Defective Products

Defective products are the cause of thousands of brain injuries every year. Defective products commonly involved in brain injury in young children include the following:

• Baby walkers. Thousands of children are injured in accidents related to baby walkers every year. Most baby walker accidents result from the baby walker falling down the stairs, a significant portion of which cause brain injury. Since 1997 all baby walkers must be wider than a standard doorway, and equipped with a braking feature that stops the walker at the edge of a step.

• Toys. Toys that are choking hazards are the leading cause of anoxic brain damage in young children. Federal legislation prevents toys with small parts from being marketed to children under the age of three, and warning labels must state the specific reason why the toy is a choking hazard. Latex balloons must also carry a warning for children under the age of eight.

• Helmets. Protective helmets have been shown to reduce head injuries in athletes and in other recreational sports participants by up to 85 percent. However, helmets that are defective or that don’t meet safety standards for strength and durability can result in brain injury.

• Window screens. Window screens that pop out easily can result in falls that cause brain injury.

• Garage door owners. Current Underwriter Laboratory standards require garage doors to be equipped with sensors that cause them to reverse when an object—or child—is underneath them when they are closing. Faulty automatic garage door openers can cause a child to be pinned under a door that doesn’t automatically reverse, resulting in brain damage.

• Power car windows. Power car windows that close due to unintentional pressure on the toggle switch—such as when a child kneels or leans on the switch—can cause asphyxiation, and brain damage.
