Hyperbaric Oxygen Therapy (HBOT) Class Action
Our attorney volunteer on Danielle’s Foundation’s advisory board is currently trying to organize a class action to get Hyperbaric Oxygen Therapy (HBOT) recognized and reimbursed by Medicaid and private insurance companies for children with cerebral palsy and brain injuries. The goal is to compel payment for HBOT for all class members (whether it will be the first time treating with HBOT or reimbursing those who have already incurred HBOT bills in the past).
This project is extremely personal to our foundation. Our attorney advisor began advocating for brain-injured children after meeting Florence, whose daughter Danielle had just suffered an anoxic brain injury. (Danielle later became the inspiration for this foundation. To learn more about Danielle, please read her story). Right around that time, Florence’s insurance company had just denied an important treatment that had really begun to help Danielle. These treatments, specifically hyperbaric oxygen therapy, were denied despite the fact that studies had proven that this therapy could significantly improve the symptoms in brain-injured children. Unable to afford the cost of these treatments, Florence had no choice but to stop treatment for Danielle.
The first step in trying to organize this potential class action will be to establish a class. We are looking for as many class members as possible that would be interested in joining. Because this is a pro bono (volunteer) project, if a class action is able to be filed, there will be no legal fees or cost to any of the class members. It will also not require any time commitment or active participation. Our attorney advisor is also currently trying to recruit the work of other volunteer attorneys to con-counsel on this project, who share his passion for ensuring that children with special needs get the therapies and treatments that they need.
